They Must Go: Senators Open Up On Withdrawing Suit Against Saraki, Ekweremadu

Senators belonging to the Unity Forum have denied withdrawing a suit it instituted seeking the removal of the Senate President, Bukola Saraki and his deputy, Ike Ekweremadu over allegation of forgery of the Senate Standing Orders 2015.



This was disclosed in a statement on Wednesday, September 2, by Mamman Osuman, a Senior Advocate of Nigeria and counsel to the forum, Premium Times reports.


The suit had been filed before the Federal High Court, Abuja by the forum, which comprises of senators who rooted for the election of Ahmed Lawan as senate president.


The Unity Forum alleged that Saraki and Ekweremadu forged the rules of the senate to facilitate their emergence as president and deputy president on June 9.


The forum was apparently reacting to reports which surfaced on Tuesday that Ademola Adeniyi, the judge of the Federal High Court struck out the case and terminated further hearing on the matter following its withdrawal by the forum.


Osuman described the reports as “erroneous and mischievous”.


According to him, the case that was withdrawn was the one filed by Anthony Adeniyi, a former senator with suit no: FHC/ABJ/CS/647/2015, dated July 24, which also challenged “the purported elections of Saraki and Ekweremadu”.

Osuman expalined that he had filed another civil suit in court with an originating summons: FHC/ABJ/CS/651/2015, adding that the second suit was filed by serving senators, including Suleiman Hunkuyi, Kabir Marafa, Abu Ibrahim, Robert Boroffice and Gbenga Ashafa.


He pointed out that both suits were different in contents.


Contrary to the misinformation put out there, we hereby confirm that the originating summons in suit no: FHC/ABJ/CS/651/2015 filed at the instance of the above-named Senators against Saraki, Ekweremadu and the National Assembly,” Osuman said.



The emergence of Saraki as Senate president and Ekweremadu as his deputy on June 9 has been trailed with controversies. A renowned Professor of law, Itse Sagay, had said the election that enthroned Saraki as senate president was fraudulent. He had also said President Muhammadu Buhari should not recognize the Saraki’s emergence as the Senate president.
